GENERAL TERMS AND CONDITIONS OF SALE

General Provisions

These conditions are exclusively valid between the company CHECK POINT SPA, with registered office in Via Parma 66, 46041 – Asola, Mantova, hereinafter referred to as "CHECK POINT," and any person making online purchases on the website www.sportika.check-point.it, hereinafter referred to as the "CLIENT." These conditions may be subject to modifications, and the publication date on the website signifies their effective date.

These conditions govern purchases made on the website www.sportika.check-point.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014, and Legislative Decree 70/2003 concerning e-commerce.

ARTICLE 1 – Object of the Contract

With these general conditions of sale, CHECK POINT sells and the CLIENT purchases remotely the tangible movable goods indicated and offered for sale on the website www.sportika.check-point.it. The contract is concluded exclusively through the internet, by the CLIENT accessing the address www.sportika.check-point.it and placing a purchase order according to the procedure provided on the site itself.

The sales contract is considered confirmed by the CLIENT upon completion of the online purchase procedure. However, for CHECK POINT, the contract is considered concluded only when the shipment has taken place and has been notified to the client with a specific confirmation email. Anything not specified is governed by Legislative Decree 206/2005, amended by Legislative Decree 21/2014, which regulates e-commerce.

ARTICLE 2 – Pre-contractual Information for the Consumer – Art. 49 of Legislative Decree 206/2005

Before the conclusion of the purchase contract, the CLIENT examines the characteristics of the goods, which are illustrated in the individual product sheets at the time of selection by the CLIENT.

Before the conclusion of the purchase contract and before the validation of the order with an "obligation to pay," the CLIENT is informed about: – The total price of the goods including taxes, with details of shipping costs and any other costs; – Payment methods.

The CLIENT can at any time, and in any case before the conclusion of the contract, access information related to CHECK POINT, including the geographical address, telephone and fax numbers, and email address, which are also provided below: Check Point S.p.A. ARTICLE 3 – Conclusion and Effectiveness of the Contract

The sales contract is considered concluded when CHECK POINT sends the CLIENT an order confirmation email. The email contains the CLIENT's data and the order number.

CHECK POINT undertakes to describe and present the items sold on the website in the best possible way. Nevertheless, some errors, inaccuracies, or small differences between the website and the actual product may occur. Furthermore, the photographs of the products presented on www.sportika.check-point.it do not constitute a contractual element, as they are only representative.

CHECK POINT undertakes to deliver the goods within 30 days from the date CHECK POINT sends the order confirmation email to the CLIENT.

ARTICLE 4 – Product Availability

Product availability refers to the actual availability at the moment the CLIENT places the order. However, this availability should be considered purely indicative because, due to the simultaneous presence of multiple users on the site, products could be sold to other CLIENTS before the order is confirmed.

Even after CHECK POINT sends the order confirmation email, cases of partial or total unavailability of goods may occur. In this event, the order will be automatically adjusted with the removal of the unavailable product, and the CLIENT will be immediately informed via email.

If the CLIENT requests the cancellation of the order, thereby terminating the contract, CHECK POINT will refund the amount paid within 14 days from the day CHECK POINT became aware of the client's decision to terminate the contract.

ARTICLE 5 – Payment Methods

All payments by the CLIENT can be made solely by means of credit cards indicated on the website www.sportika.check-point.it, or with PayPal or bank transfer. Payments can also be made using Coupons.

Communications related to payment and the data provided by the CLIENT when payment is made occur on dedicated secure lines. The security of credit card payments is guaranteed by VBV (Verified by VISA) and SCM (Security Code Mastercard) certifications.

ARTICLE 6 – Prices

All sales prices of the products indicated on the website www.sportika.check-point.it are expressed in Euros and include VAT, and where applicable, the WEEE contribution.

Shipping costs are not included in the purchase price but are indicated and calculated at the time the purchase process is completed, before payment is made.

The CLIENT accepts CHECK POINT's right to modify its prices at any time; however, the goods will be invoiced based on the prices indicated on the website at the time the order was created and specified in the confirmation email sent by CHECK POINT to the CLIENT.

In the event of a computer, manual, technical, or any other error that may result in a substantial and unforeseen change by CHECK POINT in the retail price, making it exorbitant or clearly negligible, the purchase order will be considered invalid and cancelled, and the amount paid by the CLIENT will be refunded within 14 days from the day of cancellation.

ARTICLE 7 – Right of Withdrawal

In accordance with current legal provisions, the CLIENT has the right to withdraw from the purchase without any penalty and without specifying the reason, within a period of 14 days from the date of receipt of the products.

In the case of multiple purchases made by the CLIENT with a single order and delivered separately, the 14-day period starts from the date of receipt of the last product.

The CLIENT who intends to exercise the right of withdrawal must communicate it to CHECK POINT through an explicit declaration, which can be sent by registered mail with return receipt.

The CLIENT may also exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract or, alternatively, by submitting the standard withdrawal form, as per Annex I, Part B, Legislative Decree 21/2014 (not mandatory).

In the event of exercising the right of withdrawal, the CLIENT is required to return the goods within 14 days from the day they communicated their intention to withdraw from the contract to CHECK POINT, pursuant to Article 57 of Legislative Decree 206/2005.

The goods must be returned to CHECK POINT, at the operating headquarters in Via Cremona 62/A, 46041 Asola Mantova.

In the case of withdrawal with product return at a physical store, it is not necessary to create an online return request.

The direct costs of returning the products are borne by the CLIENT.

The goods must be returned intact, in their original packaging, complete in all their parts (including packaging and any documentation and accessory equipment: manuals, etc.), and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, CHECK POINT will refund the amount of the products subject to withdrawal within a maximum period of 14 days, including any shipping costs.

As provided for by Article 56, paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, CHECK POINT may suspend the refund until the goods are received or until the CLIENT has provided proof of having returned the goods to CHECK POINT.

CHECK POINT will issue the refund by bank transfer. If the CLIENT intends to exercise their right of withdrawal, they must provide CHECK POINT, by accessing the "contact us" section, with the bank details: IBAN, SWIFT, and BIC necessary for CHECK POINT to issue the refund.

In the event of withdrawal for a purchase made with a Coupon, the amount will be returned to the CLIENT with a purchase voucher identified by a promotional code that will be sent to the CLIENT's email address, or, in case of withdrawal exercised at a physical store, the amount will be returned with a purchase voucher delivered to the CLIENT.

ARTICLE 8 – Legal Guarantee of Conformity

In case of receiving products that do not conform to orders or are defective, the CLIENT has the right to have the product brought into conformity free of charge through repair or replacement. The CLIENT can exercise this right if the defect appears within two years from the delivery of the goods and reports the defect to CHECK POINT within two months of discovery.

ARTICLE 9 – Delivery Methods

CHECK POINT will accept orders for delivery both in Italy and abroad, with varying shipping costs. Products to be delivered in Italy will be delivered by express courier to the address indicated by the CLIENT at the time of the order, no later than 30 days from the date of receipt by the CLIENT of the order confirmation email sent by CHECK POINT.

For all orders to be delivered abroad, it is necessary to send an email to customerservice@check-point.it to inquire about delivery times, costs, and methods.

For every order placed on the website www.sportika.check-point.it, CHECK POINT issues an invoice for the shipped goods. The invoice will contain the information provided by the CLIENT during the purchase procedure. After the invoice has been issued, it will not be possible to make any changes to the data indicated therein.

ARTICLE 10 – Liability

CHECK POINT assumes no responsibility for disruptions attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the internet network, in cases where it is unable to execute the order within the times stipulated by the contract.

ARTICLE 11 – Website Access

The CLIENT has the right to access the website for consultation and to make purchases. No other use, especially commercial, of the website or its content is permitted. The integrity of the elements of this website, whether sound or visual, and the related technology used remain the property of CHECK POINT and are protected by intellectual property law.

ARTICLE 12 – Cookies

The website www.sportika.check-point.it uses "cookies." Cookies are electronic files that record information relating to the CLIENT's navigation on the site (pages visited, date and time of consultation, etc.) and that allow CHECK POINT to offer a personalized service to its customers.

CHECK POINT informs the Client of the possibility of deactivating the creation of such files by accessing their Internet configuration menu. It is understood that this will prevent the Client from proceeding with online purchases.

ARTICLE 13 – Entirety

These General Terms and Conditions of Sale consist of all the clauses that compose them. If one or more provisions of these General Terms and Conditions of Sale are considered invalid or declared as such under law, regulation, or following a decision by a court with jurisdiction, the other provisions will continue to have full force and effect.

ARTICLE 14 – Applicable Law and Competent Jurisdiction

These General Terms and Conditions of Sale are governed by Italian law.

Any dispute that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the Court of Mantova. In any case, it is optionally possible to resort to the mediation procedures referred to in Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these terms of sale.
